Brixworth Parish Council Adopts the General Power of Competence

Following the local elections on May 1st, 2025 and a resolution passed at the Annual Parish Council Meeting of the 15th of May 2025, Brixworth Parish Council is pleased to announce that it has adopted the General Power of Competence (GPC).

What Is the General Power of Competence?

The General Power of Competence is a statutory power introduced by the Localism Act 2011. It allows eligible parish and town councils in England to do “anything that an individual may do,” provided it is not prohibited by other legislation. This represents a significant shift from the previous position, where councils could only act if there was a specific legal power to do so.

In essence, GPC gives councils greater freedom and flexibility to act in the best interests of their communities, promoting innovation and enabling councils to respond more effectively to local needs.

How Does a Council Qualify?

A parish council can adopt the General Power of Competence if it meets the following criteria:

  1. Electoral Mandate
    The council must have at least two-thirds of its members elected, either at a recent election or through by-elections.
  2. Qualified Clerk
    The Clerk to the council must hold a recognised qualification — typically the Certificate in Local Council Administration (CiLCA) — and must have completed the relevant training in the use of the GPC.
  3. Formal Resolution
    The council must pass a formal resolution to adopt the power at a full council meeting.

Brixworth Parish Council met all these criteria following the May 2025 election and has now formally adopted the General Power of Competence.

What Does This Mean for Brixworth?

With the General Power of Competence, Brixworth Parish Council is now empowered to be more innovative, responsive, and effective in its decision-making and service delivery.

Examples of what the council can now do under GPC (subject to existing legal constraints) include:

  • Establishing or supporting local businesses and community enterprises
  • Providing grants to a wider range of organisations or individuals
  • Investing in community infrastructure, services, or events without needing a specific statutory power
  • Partnering with other organisations for the benefit of residents

It is important to note that while GPC gives the council more freedom, it must still act lawfully, transparently, and in accordance with public expectations and budgetary constraints.
